Diversion is a program that allows for a deferral of prosecution in exchange for a defendant satisfying certain requirements.  These requirements can be discussed with a criminal defense attorney, but may include matters such as community service, substance abuse assessment and following any recommended treatment, admission of guilt to the committed offense, restitution, and more.

What Offenses May Be Eligible for Diversion in Indiana?

Not every offense is eligible for diversion in Indiana, and not every person is eligible for diversion.  Common diversion offenses include: Battery, Domestic Battery, Public Intoxication, Possession of Marijuana, Minor Consumption, Illegal Possession of Alcohol by a Minor, Theft, Conversion, Disorderly Conduct, and others.
